Returning to work from an injury: Is your job still there?

If you have been injured while at work, you may be eligible for workers’ compensation benefits. These benefits, which are provided by most employers in Maryland, are designed to help you get back on your feet following a workplace injury. In addition to providing financial assistance for medical appointments, physical therapy, surgical procedures and prescriptions, workers’ compensation helps to pay a portion of the wages that you would have earned had you kept going to work. At McGowan & Cecil LLC, we know that while these benefits offer crucial financial assistance, they do not guarantee that you will have a job to return to once you are ready to go back to work.

According to Maryland’s workers’ compensation policy, employers are not required to hold a position for employees while they are recovering from injuries obtained at work. In some circumstances, employers can simply dissolve the position or hire another employee at will. Depending on the details surrounding the case, however, you have options. You may be able to qualify for unemployment or could speak to your employer regarding your position.

There are also ways that you can minimize the risk of job loss while you are recovering from your injury or medical condition. It may help to speak to your employer on a regular basis. Maintain communication with your supervisor and keep up on what is going on at the workplace. You may be able to complete some work tasks or contribute to group discussions from home. It is important to stay involved and remind the company of the assets you provide to the team.
