An SUV that had apparently run a red light last week in southern Maryland hit a car that was turning through an intersection. The SUV T-boned a car that contained a family of three. The driver, a 39-year-old husband, and father, died at a hospital a few hours later.
Rescue crews arrived on the scene and all three of the individuals in the Ford Focus were trapped as a result of the car accident. The driver’s wife and 8-year-old daughter were both injured but were treated and now have been released from the hospital.
According to reports, it does not appear that alcohol was a factor in the accident. The driver of the SUV stated that he had fallen asleep at the wheel. An investigation is being conducted by the St. Mary’s County Sheriff’s Office.
The immediate family members of the victim may file a claim for wrongful death and seek damages to compensate them for this tremendous loss. They may be entitled to monetary damages for pain and suffering and the loss of future earnings due to the negligence of the SUV driver, as well as other monetary damages.
The mother and daughter also can seek compensation for the injuries they received as a result of the accident, including medical treatment, future medical expenses, loss of past earnings and loss of future earnings. Depending on the extent of their injuries, they may also seek damages for pain and suffering caused by the negligence of the driver in addition to other damages.
